Namaskar. This is to remind abt what happended in Property owners dinner meeting many years back.

There r always two sides of coin. Many a times one has seen only one side and shouts on top of voice abt what he thinks is right. This is one sidedeness, ekantawad, and ignorance so can be dubbed as foolishness. I have been fool all my life and god has given me a very bitter kick to start seeing the otherside too.
 
 
U may have forgotten but I have been constantly remembering this as burden and by writing this letter I am trying to wipe my sins and tears.
 
Pl. note that ur daughter had said some thing abt atrocities on women in open forum of a meeting of POA at Orient Club Chowpati. Till then I had expirienced only atrocities by women. I got and said something against her issues. I apologise for same. Pl. convey this to her. Coin has two sides. Jainism stronly recommends anekantwad. But I was a fool. Having taught lesson by god I come to you and ur daughter for fogiveness.
 
I am sure she must have faced sever trauma to gather courage to speak on atrocities on women. Due to my one sidede knowledge I washed away her issues with my oratory. But god and her hurt feelings have given me lesson of life. It has made me apologise to her so curse on me is removed and woken activist in me to work in that feild too and not against jusicial system, against rent act and against atrocities / negligieance of sr. citizens.
 
Hope you and ur beloved daughter will pardon me. Pl. let me know if I can be of any assistance to you  ur family and specially ur beloved daughter.

Dear Krish,

 

very true. No profession be it medical, education or religion ( Guru, saint,pujari,father,maulana) etc are any more noble.

 

 Recently at 2 am my father became breathless. He was already not well for a month. I rushed him in ambulance to Hinduja. There they very promptly stabilized him in casualty but then they said they have no place in ICU and that we shud shift him.

We checked at seven hills who described the charges on phone itseld and told us to come over.Seven hills is little far and is in area which remains heavily traffic jammed. Then we called another hospital ( I want to avoid taking name) as same is headed by a good doctor and has good facilities ( but ethics???) and is only 7 minutes away from my house thus is nearest pvt hospital for me. They said they have a place in ICU. We rushed him there. They took him in to casualty and from there to ICU. Then I was asked to go and finish formalities of registration. There they surprised me by saying that I can not decide/ opt for a class I want for my patient. They said hospital policy is that emergency patients are given only Deluxe class ( room rate Rs 9500/- per day , doctor visit Rs 1700/- per visit and other charges high accordingly).

 

When I showed my reluctance , insited that there is no such rule which can allow this to happen in our country ( but in my heart I knew it is only in our country that common man are fleeced , duped,harrassed, armtwisted, blackmailed, illtreated and rich, who's who, VIP's are treated like maharajas ( see this hospital itself where there is luxurieos VIP lounge,  but has  badly kept dining room for relatives of patients behind in the dump area ) . The counter in charge then said u may pl. talk to Dr Yadav tomorrow and she may consider to down grade our room. With some reluctance I paid the deposit. From then own I kept following up with Mrs yadav and all others I cud approach and find contacts. I also carried my IT papers to support my case.

 

After 3 days keeping my request on hold they flately refused to do anything.

Ofcourse they have there policy and I have mine of activism and not to easily give in to arm twisting. I warned them politely. They stuck to their guns..of course it was worst then AK 47.

 

I had no choice but to take out my weapon given by beloved Bapu Gandhiji.

 

I made 3 posters :

1. so and so hospital have some heart.

2. Dr so and so fear God

3. stop armtwisting of emergency patients

 

One I pasted thru cello tape on my shirt , second I hired a poor boy and asked him to stand on gate and third I put up on my car parked on gate. I purposely selected time of 8 pm as 95 % of visitors are gone by that time as I wanted to avoid big scene ( did not want to use Ironman's hammer where gold smith hammer can work). I quietly started roaming in their palatial lobby. Slowly some relatives ( out of remaining 15 -20 ) before 7 pm there r more then 200 ) started murmuring, one or two gathered courage and came to me , appreciated, started telling their problems too, etc.. Hosp staff kept on looking from distance. They were in for a surprise and did not know what to do. Finally a team of 3 sr. managers who were leaving for home spotted me and came to me. The lady heading them was having extraordinary  PR skills ( as if I am talked rough,loud,wrong language etc then I too loose my temper and then in short madness big scene is created) and sat clsoe to me, discussed the issue which I said :

 

1. I should have been told on phone that these are our terms and condition and charges when I had called up. After calling me with emergency patient, taking him in charge they can not
give me any rude shock?

 

2. They should have refused my request on first day as then I cud think of shifting patient to other hosp.

 

3. As a consumer I have a right to select the product and services of my choice and budget and know damages in advance. They have other rooms available then how can they insist that I must opt for the one which they would like ?

 

4. I also asked on what criteria / reasoning my request to down grade was refused and without even having look at my IT papers. Just whims or because I was not having some sr. bureaucrat, union to side me??

 

5. I highlighted that my patient was 88 yrs old Sr. citizen and that definitely deserved a soft approach.

 

She rushed in  ( I can only believe she must have had to negotiat very hard for my case)  and came back with an announcement that my request is granted. My bed charges came down by 50%. and doctors charges from whopping Rs 1700 to Rs 600/- per visit etc..

 

 

By the way there is a path lab in Santacruz east which has lowest charges and has written on board that we are lowest because we don't give any commission to doctors. And pl. note that there are no doctors who recommend that lab and only send to ( I will again avoid taking names)

 

Most family doctors for even small ailments refer in writing to specialists. The best option is to say if your roll is over then we will select the specialist / hospital and don't go with their letter. Even if specialist / hospital does not want you to over bill / do unnecessary surgery/ tests but they have to as the doc recommending wants big cut and if he does not get then next time he will not send Murga / bakra/  innocent client.

 

Caution: Many tests some times are necessary too to rule out and narrow down on problem so all negative tests do not mean that they were unnecessary.

Caution2 : I knew I am between good people ( may be little less ethical) and not in the hands of criminals but if I was in UP/ Bihar/ bureaucrat run place then I would have not done even this mild peaceful activism as there cud have been threat to patients life.

Caution 3: Let us prepare and arm ourselves with knowledge, procedures, policies, etc of medical profession so we are not taken by surprise. Someone can start a yahoo group / a discussion forum for common man who may need / are in need to share hospital experiences/ woes/expenses.Atleast that is our birth right as a free???? citizens of free??? nation.

Dear All,

 

Corruption has many names, and one of these names is "commission". The government is no doubt corrupt… but civil society isn't innocent either. Professionals and businessmen of various sorts indulge in unscrupulous practices. I recently had a chat with some doctors, surgeons and owners of nursing homes about the tricks of their trade. Here is what they told me:

 

1)      40-60% kickbacks for lab tests. When a doctor (whether family doctor / general physician, consultant or surgeon) prescribes tests – pathology, radiology, X-rays, MRIs etc. – the laboratory conducting those tests gives commissions. In South and Central Mumbai -- 40%. In the suburbs north of Bandra -- a whopping 60 per cent! He probably earns a lot more in this way than the consulting fees that you paid him!

 

2)      30-40% for referring to consultants, specialists & surgeons. When your friendly GP refers you to a specialist or surgeon, he gets 30-40% from them.

 

3)      30-40% of total hospital charges. If the GP or consultant recommends hospitalization, he will receive kickback from the private nursing home as a percentage of all charges including ICU, bed, nursing care, surgery etc.

 

4)      Sink tests. Some tests prescribed by doctors are not needed. They are there to inflate bills and commissions. The pathology lab understands what is unnecessary. These are called "sink tests"; blood, urine, stool samples collected will be thrown into the sink.

 

5)      Admitting the patient to "keep him under observation". People go to cardiologists feeling unwell and anxious. Most of them aren't really having a heart attack, and cardiologists and family doctors are well aware of this. They admit such safe patients, put them on a saline drip with mild sedation, and send them home after 3-4 days after charging them a fat amount for ICU, bed charges, visiting doctors etc.

 

6)      ICU minus intensive care. Nursing homes all over the suburbs are run by doctor couples or as one-man-shows. In such places, nurses and ward boys are 10th class drop-outs in ill-fitting uniforms and bare feet. These "nurses" sit at the reception counter, give injections and saline drips, perform ECGs, apply dressings and change bandages, and assist in the operation theatre. At night, they even sit outside the Intensive Care Units; there is no resident doctor. In case of a crisis, the doctor -- who usually lives in the same building -- will turn up after 20 minutes, after this nurse calls him. Such ICUs admit safe patients to fill up beds. Genuine patients who require emergency care are sent elsewhere to hospitals having a Resident Medical Officer (RMO) round-the-clock.

 

7)      Unnecessary caesarian surgeries and hysterectomies. Many surgical procedures are done to keep the cash register ringing. Caesarian deliveries and hysterectomy (removal of uterus) are high on the list. While the woman with labour-pains is screaming and panicking, the obstetrician who gently suggests that caesarian is best seems like an angel sent by God! Menopausal women experience bodily changes that make them nervous and gullible. They can be frightened by words like"cysts" and "fibroids" that are in almost every normal woman's radiology reports. When a gynaecologist gently suggests womb removal "as a precaution", most women and their husbands agree without a second's delay.

 

8)      Cosmetic surgery advertized through newspapers. Liposuction and plastic surgery are not minor procedures. Some are life-threateningly major. But advertisements make them appear as easy as facials and waxing. The Indian medical council has strict rules against such misrepresentation. But nobody is interested in taking action.

 

9)       Indirect kickbacks from doctors to prestigious hospitals. To be on the panel of a prestigious hospital, there is give-and-take involved. The hospital expects the doctor to refer many patients for hospital admission. If he fails to send a certain number of patients, he is quietly dumped. And so he likes to admit patients even when there is no need.

 

10)  "Emergency surgery" on dead body. If a surgeon hurriedly wheels your patient from the Intensive Care Unit to the operation theatre, refuses to let you go inside and see him, and wants your signature on the consent form for "an emergency operation to save his life", it is likely that your patient is already dead. The "emergency operation" is for inflating the bill; if you agree for it, the surgeon will come out 15 minutes later and report that your patient died on the operation table. And then, when you take delivery of the dead body, you will pay OT charges, anaesthesiologist's charges, blah-blah-blah.  

 

Doctors are human too. You can't trust them blindly. Please understand the difference between:

 

·         Young surgeons and old ones. The young ones who are setting up nursing home etc. have heavy loans to settle. To pay back the loan, they have to perform as many operations as possible. Also, to build a reputation, they have to perform a large number of operations and develop their skills. So, at first, every case seems fit for cutting. But with age, experience and prosperity, many surgeons lose their taste for cutting, and stop recommending surgery.

 

·         Physicians and surgeons. To a man with a hammer, every problem looks like a nail. Surgeons like to solve medical problems by cutting, just as physicians first seek solutions with drugs. So, if you take your medical problem to a surgeon first, the chances are that you will unnecessarily end up on the operation table. Instead, please go to an ordinary GP first.

    1.Dear Sureshji is putting in enormous efforts in making the Yatra a memorable one. Hope everyone has confirmed.Pl. dont wait for others to confirm. And if one of the spouse can not make it for some reason then atleast the other one must not miss the opportunity to go in such nice group and to a yatra.
     
    We came alone and will leave this world alone so opportunity to go to a good religious place should not be missed.
     
    2. Pl. note that this is a time of CSR ( corporate social responsibility) . So atleast as a social group our social responsibility goes up. And we must do something differant. here is an opportunity. I had visited Gajpantaji 2 months back.While they have made beautiful temple at Gajpantaji ( below hill) but the toilet was?????? Huh ...huh ....ooo... my god. When we r all there ( subject to daddy's health I amy or may not be there) we must look at this as an opportunity and make a modern toilet there from our side.
     
    Let us have few temples / Murtis but have them in neat, beautiful, seren environment with basic modern amenities.

    New Government Authority to Investigate Financial Frauds

    Introduction - Taking clue from the developed nations Indian Government has also established a multi-disciplinary organization under Ministry of Corporate Affairs to investigate serious financial frauds committed in India. This office known as "SFIO" is working with the help of experts in the filed of accountancy, forensic science, auditing, law, information technology, investigation, company law, capital market and taxation. SFIO is extensively being used by the government for detecting and prosecuting white-collar crimes / frauds. The SFIO investigation is generally undertaken in the circumstances where public interest is involved or the fraud has multi-disciplinary ramifications.

    Structure - The Government approved setting up of this organization on 9th January 2003 on the basis of the recommendations made by the Naresh Chandra Committee which was set up by the government to study corporate governance. The Charter of SFIO was issued by the Government on 21st August 2003. Serious Fraud Investigation Office started functioning from 1st October 2003. This organization was set up in the backdrop of stock market scams, failure of non financial banking companies, phenomena of vanishing companies and plantation companies etc. This is a new organization and does not have separate statute to govern it for the present and in the interim period the investigations are being carried out under the provisions of Companies Act 1956. SFIO takes up investigation of the cases of alleged frauds referred to it by the Central Government under section 235 / 237 of the Companies Act 1956.

    Companies Act - The Central Government is empowered under the provisions of sub-section (1) of section 235 of the Companies Act, 1956 to appoint one or more competent persons as Inspectors to investigate the affairs of a company and to report thereon in such manner as the Central Government may direct where a report has been made by the Registrar under sub-section (6) of section 234.

    Similarly, the Central Government under the provisions of section 237 of the Companies Act 1956 shall appoint one or more competent persons as Inspectors to investigate the affairs of the company if –

    (a) The company, by special resolution or the Court, by order declares that the affairs of the company ought to be investigated.

    (b) In the opinion of the Company Law Board there are circumstances suggesting that,
    (i) That the business of the company is being conducted with intend to defraud its creditors, members or any other persons or otherwise for a fraudulent or unlawful purpose, or in a manner oppressive of any of its members, or that the company was formed for any fraudulent or unlawful purpose.
    (ii) That persons concerned in the formation of the company or the management of its affairs have in connection therewith been guilty of fraud, misfeasance or other misconduct towards the company or towards any of its members.
    (iii) That the members of the company have not been given all the information with respect to its affairs which they might reasonably expect, including information relating to the calculation of the commission payable to a managing or other director or the manager, of the company.

    The Powers - The powers of the Inspector for carrying out the investigation, as listed in section 239, 240 and 240 (A) of the Companies Act are as follows:-

    The appointed inspectors may investigate the following entities and may use other avenues of investigation mentioned herein below:

    (a) Any other body corporate which is, or has at any relevant time been the company's subsidiary or the holding company, or a subsidiary of its holding company, or a holding company of its subsidiary;

    (b) Any other body corporate which is, or has at any relevant time been managed by any person as managing director or as manager, who is, or was at the relevant time, the managing director or the manager of the company;

    (c) Any other body corporate which is, or has at any relevant time been, managed by the company or whose board of directors comprises of nominees of the company or, is accustomed to act in accordance with the directions or instructions of the company, or any of the director of the company, or any company, any of whose directorships is held by the employees or nominees of those having; the control and management of the first mentioned company;

    (d) Any person who is or has at any relevant time been the company's managing director or manager, the Inspector shall subject to the prior approval of the Central Government have power so to do and shall report on the affairs of the other body corporate or of the managing director or manager, so far as he thinks that the results of his investigation thereof are relevant to the investigation of the affairs of the first mentioned company.

    (e) To call all officers and other employees and agents of the company to preserve and produce before him or any person authorized by him in this behalf with the previous approval of the Central Government, all books and papers of, or relating to, the company or, as the case may be, or of relating to the other body corporate which are in their custody or power.

    (f) With the prior approval of the Central Government may require any body corporate other than a body corporate first one to furnish such information to, or produce such books and papers before him or any persons authorized by him in this behalf (with the previous approval of the Government) as he may consider necessary if the furnishing of such information or production of such books and papers is relevant or necessary for the purposes of his investigation.

    (g) Under the provisions of section 240A of the Act where the Inspector has reasonable ground to believe that the books and papers of, or relating to any company or other body corporate or managing director or manager of such company or body corporate may be destroyed, mutilated, altered, falsified or secreted, he may make an application to the Magistrate of the First Class or, as the case may be, the Presidency Magistrate, having jurisdiction for an order for the seizure of such books and papers.

    The Procedure - As the investigations are carried out under the provisions of the Companies Act, the Officer appointed as Investigating Officer by the Government has the final say in the matter related to investigation. The working groups of the officers constituted by the Director, SFIO in consultation with the I O, to assist the Investigating Officer are required to render him all possible assistance in the respective areas of their specialization so that the issues are examined from a multidisciplinary angle. He supervises the entire investigation and coordinates with subject specific team leaders in the matters related thereto. The Investigating Officer, after conclusion of his investigation, submits the Investigation Report to the Central Government in the Ministry of Corporate Affairs.

    Administration - For smooth functioning of the administration of the SFIO office, the Director has been declared 'Head of the Department'. He exercises the powers of HOD. He is assisted in this task by one of the Additional Directors who has been given the charge of Administration. Under him there is an administration unit headed by a Deputy Director who is assisted by two Assistants.

    Time Frame - For each investigation that is to be carried out by the officers of this organization, the Central Government while ordering the same assigns a time frame. The investigation has to be completed within that time frame. The subject specific groups of officers which render necessary assistance to the Investigating Officer have to examine the issues involved in the case within a given time frame and give requisite inputs to the Investigating Officer.

    Recommended Prosecutions - As per the information available, SFIO after their investigation has recommended prosecution the following companies.

    Every where jagruk/ enlightened/ responsible citizens r changing their locality but for TPS III / santacruz residents who love traffic jams/ noise/ dirt/ water logging/ flooding/ encroached foot path,etc etc .
    Santacruz east has not a single good park like Bandra/ juhu / BKC has. It has not got any good recreation club.Nazma Haptulla  made one ( nr reliance energy)but is used for commercial activity etc etc . There is no good hospital no good mall no good theater but backward people like living like that.

    Also a Good news, Railways have issued tenders for completion of pending work of Kurla Subway, and railways pending work would be completed in 9 months by year end. We need to press on BMC also to issue such tenders to complete their part and open the subway.

      My activist friend have received the reply to RTI. Same is evasive and incompelete. But he is not going for 1st appeal as you had some compassion and good behaviour when I had been called to your office.
       
      However since we want proper reply and clear and in detail we aremaking fresh simple application. Pl. give detailed reply with necessary enclosures like which circular tells to to take affidavit inspite of having probate.
       
      Hope you will do the needful. Pl. note that I have retired at this early age from active busines to cleanse the system as far as possible. I shall persue the matter till end so instead give very clear reply with all supoting GR/ circular/ laws/ acts etc..

      I  am sending you soft copy of RTI query. I will be sending the print out too to worli.
      My request is to not to give evasive reply. Put up notice board, charts, useful info on all choki too ( like on your web site). Let us mame democracy a people friendly and not just officials friendly.Let us use 3 language formula and under that pl. reply in Marathi, Hindi or English as desired by applicant. I want reply in english. Also provide copy of reply by email so same can be widly circulated.

      6.       Pl. give how many towing vans are in service in this jurisdiction?

      7.       Pl. give name, address and vehicle no. of towing vans and no. of towing done by each one of them during above period?

      8.       How much is being paid to towing van owners. Is it per towing? So how much has been paid to each of above towing van per month since January 2010 till the date of your reply? And how much has been collected for govt. treasury against same no. of towing?

      9.       Which authority decides type of parking and parking / no parking zone?

      10.    On Pali ram road next to BMC Brahamakumari Hospital off S V Road, Andheri west there is some parking space reserved for BMC. Who has sanctioned that parking reservation? Pl. furnish copy of relevant order?

      11.    I had asked for copy of that order from Choki which lets parking reservation for BMC on that road and in case of anyone else parking it authorizes your dept to tow away the vehicle. They did not have that copy. Are they acting on verbal instructions of someone influential  or they are acting on official instructions?? Pl. furnish copy of official instructions to that effect.

      12.    What are the documents demanded when one approaches to get his towed vehicles released?

      13.    Why there is no notice board on traffic police choki near Andheri flyover west?? We find many boards in local police station, ration office and all other places but traffic police station. Why there should not be a chart on display that suggests documents required while getting towed vehicle released/ the various offences and fine there too, no. of vehicles towed and type of vehicles towed/ prominent traffic jam roads and their parking instructions etc etc..

      14.    Why there is no board to show address PIO under RTI at this choky?

      15.      Who sanctions pay and park facilities?

      16.    Who sanctions towing vans on contract to your dept.?

      17.    Pl. give name ,address, copy of shops and establishment license, copy of service tax license  of S Yadav Towing service and name and address of owner of S yadav towing service.

      18.    Which authority sanctions PUC checking centers/agents? Give full contact details.

      19.    I state that information sought does not fall within the restrictions contained in the Section 8 & 9 of the Act and to best of my knowledge it pertains to your office.
