Pl. advise

Dear All,
Namaskar.
  1. My one of the known activist had sent RTI application to LIC MDO III, santacruz. They insisted person applicant should come personally. Then they called up and said to her that they can give telephonic reply. After 17 calls and 2 hrs delay they have accepted the application.LIC which we think is sacred org. of Govt of India has this respect towards constitutional rights of citizens. Any action can be taken on such behavior?
  2. LIC recipient has only given an initial as an acknowledgement. They have not given any seal or designation , Inward no. on our copy. Is this the way LIC/ Govt depts/corporations should receive the hand delivered mail / applications?? What guidelines say?
  3. I had sent an RTI application to Traffic police. After 4 days constable came with a letter from them at night 9.30pm. at my residence. The letter did not contain any tel no or email id for follow up/ clarification. When police in Mumbai is overworked and under staffed then what of the need of in uniform constable to come personally that too at non working hours? I had given all my contact nos and email id in my application. They cud contact me on mobile, thru email or post/ courier the letter. What is a guideline on this?
  4. Municipal corporation officers just do not care to reply properly to RTI queries? Have any BMC ( who has looted Mumbai openly and made it Slumbay been ) been ever been penalized for this?

Thanks and Regards,

I have raised issues ( police and court both) for loss of compounded loss of crores to Citizens

but individually looks a small theft/ loss.

Application for seeking information under RTI

(See rule 3)

To The Public Information Officer

Sr. Inspector,

Vakola Police Station, Vakola

Santacruz East,

Mumbai 400055

1.      Name of the Applicant                 :Alok  Tholiya (S E O)

2.      Address                                              :Tholiya Bhavan, 10th Rd., Santa Cruz East, Mumbai 400055

Tel No. 9819733059/ tholiya@yahoo.com

3.      Information sought: - No. of complaints received about loss/ theft of Mobile handsets, its gross value, approx time taken to attend the complainant, how many mobile recovered, how many mobile recovered and delivered to their original owner, how many mobile thieves were  arrested and how many were released by court for insufficient evidence.

4.      All information pertains to Vakola Police Station and statistics required are for period 1 st January 2010 to till date of your making the reply.

5.      Pl. give me details of actions taken on my complaint no. / Gahal vastu nonda vahi no. 3978 dt. 30/06/10 for loss of my costly handset.

6.      Pl. inform when IMEI no. is given then what efforts were made to locate my handset and what was the outcome?

7.      Was thru IMEI no. my handset was atleast blocked so it is not used by others?

8.      When police dept. is so busy with other law and order issues and VIP extravaganza then why not allow handset owners to directly follow up with handset and service providers in case of a theft of handsets? Why govt. and its agencies are collecting with open arms all additional responsibilities which they cannot cop up with (due to insufficient staff/ infrastructure and low morale. Low spiritualism and low motivation)?

9.      Pl. inform how many complaints have been received since 1st Jan 2010 till date about loss of mobile handsets in Vakola Police station?

10.  Pl. inform the gross value of mobile handsets reported lost during this period?

11.  Pl. inform how much time of a complainant goes in police station when he comes to report loss of mobile handset?

12.  Does he have to follow up by frequently visiting police station?

13.  Are you closing the loss of mobile handsets complaints as mere information or are they recorded as F.I.R.'s?

14.  During the above period how many mobiles have been recovered? How many of them have been delivered to their original owners?

15.  How many mobile thieves  / snatchers etc you have arrested during the above period? Haw many of them have been given easy bail by Hon. Courts so they can happily carry on with their snatching activities? This is a general impression that law and order is bad in country because courts are place of harassment of victims and place of leniency towards criminals.Pl. comment? In one of the lectures in our Lions club the then police commissioner had said our staff plays on life and nabs the worst of criminals but courts quickly give them bail and then most of them are out on bail for years and matter becomes weak.Pl. give figures as to how many thief's, burglars, snatchers are punished and how many are let loose by courts on bail or with mild punishments which do not act as a deterrent and rather acts as a encouragement.

16.  Also give reply to question no. 15 for period starting 1st January 2005 till date.

17.  Pl. give religious back ground of mobile thieves? Say how many of them are Hindus, Sikhs, Jains, Muslims, Christians etc..

18.  Pl. give their age group?

19.  Pl. give their gender?

20.  Is it possible that staff of police gets the user of snatched handsets thru IMEI no. Contacts the illegal user. Settles the issue with him and does not report to original handset owner? This is my inference as my mobile was pick pocketed in a bus near Vakola police station junction. It was a costly handset worth Rs. 18500/-. I had given IMEI no when your officer asked for same. When your staff has the IMEI no then they must have easily found out the new illegal user thru mobile service providers. But what transpires between police and service providers and illegal owners is not transparent to us. Pl. comment in detail all procedure for finding the location of handset thru IMEI no.

21.  How many IMEI nos. Vakola police station has so far sent to service providers during above period? What is the outcome?

22.  Pl. give me copy of your note to service provider and also copy of their reply to Vakola Police station against my IMEI no. 352922020671540 as reported in my complaint.

23.  Pl. give me contact details of agency which keeps statistics of total nos. of mobiles lost in Mumbai, their worth (which according to me is in crores).

24.  Is there any law which prohibits buying and selling of mobile handsets without exchanging copies of original ownership documents, copy of PAN card etc..? If not then has police asked for such law so illegal sale by thieves are curtailed. There r so many shops/ stalls and websites selling stolen handsets in the name of second hand. What actions are taken to control them. Web sites like adult insist one to state that they are above 18 similarly all buy and sale web sites / classified web sites (many are floated by gang of stolen good s) must ask advertiser to state whether you possess valid ownership documents. Pl. forward this suggestion to concerned home ministry to bring necessary legislation.

25.    What is the official contact no. and email id of Information officer should we require to talk to him in future for official purpose.

26.   What is the name and address, tel. no and email id of appellate authority in case we need to go in appeal.

27.   I state that information sought does not fall within the restrictions contained in the Section 8 & 9 of the Act and to best of my knowledge it pertains to your office.

15. This is to certify that I, Alok Tholiya Son of Shri B L Tholiya, am a citizen of India.

16. A court fee stamp @ of Rs. 10 has been affixed herewith.

12. Pl. advise us in writing In case there is need to pay any additional fees. Same will be paid promptly.

13. Pl. send the information requested by post to me at my address. Any postal charges if any will be paid by me.

FW: IndianMuslimObserver.com.................Alok adds:

  • Whatever in hurry I could read and understand I take Dr Wasim as a roaring Lion amongst 98% silent good muslims. So we hear only 2 % who r irresponsible, non visionary, non democratic and then entire lot of Muslims get painted with views, demands and acts of these 2%. IF more voices like of Dr Wasim r heard then more and more non muslims will find reason to get compassionate to problems of Muslims.
Besides, yes more educational institutes, sports and cultural centers r required in J & K and other places in India. But I find which ever is a place where life and property are under constant threat no enterprising privates dare to come and govt is reluctant to send their staff as they r worried abt their life/ kidnapping etc..
Only peaceful ways r best way to fight for right as they cant be silenced by guns ( whole world is watching),and simultaneous progress also goes on as no one feels threatened. See for urself while people r running to China,Dubai,Singapore,Malasia for all business but not to Afganistan etc why?? Let the residents of affected areas give suitable peaceful safe conditions so these things flow in.
And out of 2% irressponsible muslims only .1% may be terrorists but they have damaged the life and progress of 100% due to their acts which lets law and order machinary to retaliate badly without getting whipping as action is thought to be against terrorists.
And why not take a lead and have ur own institutes for modern education, health services etc which is totally as per Ur religious beliefs. But good things of religion gets shelved and others issues r raked up to control masses but which puts them 50 years behind others.Dont go to taliban and other similar people go to malaysia and dubai and learn how they progressed inspite of being Muslim dominant society and take best out of them and implement while respecting our law and limitations. With people like Dr Wasim things can be wonderful if majority of his people support his thoughts and refuse to cow down to .1% extremists.Wishing Happy Eid and beautiful world ahead full of love, progress and peace. OPINION: Kashmir - Freedom From What & Whom?

    Posted: 15 Nov 2010 03:18 AM PST

    By Dr. Wasim Ahmad

Wherever Muslims think that they are a special people – in their sense of the word – there is a huge problem there. Whenever they ask for a separate homeland then it raises serious doubts about their understanding of Islam. It makes me think that they are asking for something which Islam may not ask them to ask for. In all such situations it occurs to me to visualize what would have been the reaction of the Prophet Muhammad (pbuh) in such cases. We – as Muslims – cannot escape this question as we cannot separate Islam from Muslims. If the entire earth is a "masjid" and "pure" then how could we divide it? How the 'uniters' could be the dividers, is a question that always intrigues me. How could those who truly know that the man has been created in "toil" be assuming and aspiring to start living in a "Paradise" without first doing their best to turn this entire earth in a Paradise-like place?

How could we forget that what is needed today is not the blood that is spilled from our necks in a minute but the ever-oozing sweat of our foreheads for the entire life – as suggested by Dr Zakir Hussain? How do we expect maximum justice from the rest of the world and not from ourselves? I also wonder what we want to be free from. What do we want to run away from? If we really want to run away from something then it should be from ourselves. We need to run away from ourselves – the selves which are not of much worth, not of much value. How could these selves be of much worth and value with the amount of prejudices, with the amount of biases and with the current notions of being a 'special people' who cannot peacefully co-habit with 'others'? If we had truly realized that we were a special people – as the upholders of the beautiful message should be because of their responsibilities – then precisely for the same reason we should have sought more engagement with the entire Hindustan, instead of trying to run away from it. But then we as a people have a behaviour pattern of markaz gureziyat ('centrifugality') and we don't mind reinforcing it on a daily basis.

There is another pattern noticeable among the Muslims currently. In many a cases, where in majority they have their internal divisions and sectarianism on the peak. Where they are living with a majority and under a bigger setup they are less internally divided, I guess. We ask for a separate homeland because we do not look at the customers (mad'oo) as customers and salespersons (daa'ee) as salespersons. If we still get a separate homeland and the less competitive environment does not allow bringing out the best in us then it is not worth it. If we get a separate homeland and the sectarian divide gets wider and wider then it is not worth it. If we get a separate homeland and start slitting each others' throats everyday then it is not at all worth it.

Those who were expected to free India from diseases, poverty, illiteracy and from many more ills, evils and bondages are fighting for their own freedom. To me it amounts to saying, "You go to Hell. I want my personal and exclusive Paradise". It amounts to saying, "You deal with all your problems alone. I am not going to contribute my bit". Coming from Muslims, these (unworded) statements sound strangest to me. And reinforce the impression that the real spirit of the very Faith we untiringly swear by is eluding us. This is why instead of earning freedom for others we are trying to earn it exclusively for ourselves. This is a paradox!

In a forward-looking world where individuals are getting more and more empowered and where the boundaries may increasingly matter less and less we are determined to create more boundaries. It is as if we are not satisfied by not being able to travel to those cities and places which actually we want to but we cannot – easily. Why shouldn't we freely "travel in earth" and see the Signs of Almighty? Are the existing restrictions not enough? When will we live by the Faith that we are ready to die for?

If it is true that "only the educated are free" then we should ask the Indian Government to establish more Universities (and industries) in Kashmir. One of my professors once suggested it over ten years ago and I have been thinking about it ever since. Not focusing on the present and the available we waste a lot in pursuit of an unknown future. In pursuit of a perfect future – the kind of which has never existed. But history in our case is not of much use. All this is quite possible in the case of Muslims because of a big number of writers and speakers who do not think twice about what they are writing and speaking. Because educated, too, are expected to think at the level of an 'ordinary' man IGNORING the fact that a lot has been invested in them so that they do not think at that level and in that manner.

It is self-contradictory to me that we have Colleges and Universities and still we are fighting for freedom. It only indicates that we are seeking it from without and not from within. Let our Colleges and Universities give us the freedom which currently we are seeking from others and through different means. This freedom will be loved by those, too, who are not willing to 'give' us freedom now. My plea to my brothers and sisters in Kashmir would be:

yeh judaa'iyouN ke rastey bari door tak ga'ey haiN
jo gayaa woh phir na aayaa, meri jaan lout aa'o

Sometimes we think that there are a few options in a matter. But in fact there may not be any. If we keep the whole picture in view then we may be obliged to opt for only one of those 'options'. The Prophet Muhammad (pbuh) had no options in Makkah or wherever he was and happened to be. He was offered many options, though. A mother whose son falls in a river has no option but to plunge in it. The Muslims have no options but to engage with the world and be in the thick of it. They don't have an option of escaping their responsibilities as regards the society and the ailments in it.

My plea to my brothers and sisters in Kashmir is to stop playing in the hands of those who may be playing with them. We cannot afford further loss of life and property. We should not sacrifice further lives because we have sacrificed more lives earlier. We have to come out of this vicious cycle – at some point of time. I would like to tell my brothers and sisters in Kashmir that we have a different kind of leaders today. They don't tell us that the problems are within. They tell us that the problems are outside and with others. Let us stop cheering for them and start looking inward.

The other plea to my brothers and sisters in Kashmir is to contribute their maximum to the following VISION: The students coming out of our Colleges and Universities should have Qur'an in the right hand, most modern scientific and technological advancements in the left hand and the crown of Laa Ilaah on the forehead. So that the Muslims regain the same glorious status of founders and promoters of science and technology as they did during the ascendance of their civilization.

This is the shortest (though apparently the longest) way to earn freedom for ourselves and for others from all kinds of subjugations.

Re: Re. : Press cutting on our plight at Indore Airport

Machine can fail. We can understand. But we can not understand failure of truthfully updating, giving immediately alternate arrangement, giving comfortable stay to atleast  sr. citizens, sick etc..

First things first. All airports should have retiring room for such delays where they can atleast shift old, sick and disabled even if delay is for an hour or so.But here Jet did not take care of  them for whole night.Inhuman.These young execs r so egoist and in their own world (due to high salaries and lavish offices for them selves that they treat consumers as dogs ...my expirience in recent fair organised by Economic times, banks, other services r such that these highly paid execs think nothing of others and nibble everything by themselves) (hurting some of my own group subscribers and young friends??? yes but truth  is truth).

But now a days all corporates and their execs think of only own comforts and prfits and not of customers.MBA's are worst exploiters.( And tata huge gave donation for MBA institute). Rather he should have funded those who teach compassion, care, love and quick reaction to others sufferings.

Anyhow this cold blooded attitude goes on because we all r too busy to take it up in consumer courts and then we r reluctatnt to go to courts as we here they r sold out , red taped and harrassment tools of mightys of India.

Arun, Inspite of bad consumer courts atleast take up one case in life time to such body ( we cant go to US or International court an option should be given as we cant trust ours) to teach a lesson to these who fleece commonman.

    My Hathway connection from Hinduja's

Hindujas r very nice ( charitable, non alcoholic, veg) people. Have enough.
Yet I fail to understand why they eneter a line where they can not match the world standard rather not even Indian standard ( I have another MTNL broadband connection and I m more then happy).

Finally I m tired of complaining and swithching over to MTNL 3G wireless broadband. Today I shall go and apply for same and then bid farewell to Hindujas owned Hathway broadband poor services/ frequently failing services.

By the way is there any blog/ newspaper/ website which compares various services ( in telecom, cable, sat top,IPTV,broadband, mobile, landline like IRDA compares various insurance cos) so we can choose the best and there is compitition amongst various players.

    Dear Alok,

Am in agreement with what you have written.  Honesty does not pay and
those who are upright are looked down upon.  BUT that does NOT mean
that right thinking clean people should suffer the unclean majority.
I am with you and share your views.  Keep up the good work.

RE: Sayyad bhai has thrown a brilliant question who none r able to awnser but.........Alok

No one ever told you this ..... no one has courage... but Alok does not mind making whole world enemy. Some want to kill me / hate me / wish I die but I would take that as a wish of god and vice a versa will not take wrong statements as wish of god.....Alok

U r right cent percent. But Sayyad bhai what have we all done to ensure that Mr Clean rises. If there is a Mr Clean in our area/community we ignore him and only respect one loaded with money, has car , has lots of influence, throws parties etc etc. Mr clean r side lined by all, ignored, even family looks at him with hate as he is not able to make money. Media will cover any one who bribes, throws cocktail parties, gives controversial statement, is communal, who allotts flats to journalists, who takes them to foreign trips, gives them VIP passes and gives them ready made news to be cast. Since Mr clean is unbias, can not throw cocktails, can not favor media etc etc he never gets press coverage. So either  Mr clean dies in suffocation / depression or becomes spiritual and resigns to fate/ destiny. I have in my life seen so many unsung honest officers and politicians wgho cud not rise in life and nothing was wrong with them but was totally ignored by masses and media. U want to try????

Go as a ordinary man to any gathering , live in honestly earned one room apartment, live simple and see the treatment you get from society. On the otherhand earn black money, do frauds, committ crime ( but police and judicial system) , throw party ( and all who's who will attend), drive in in a shuafer driven premium car   and see how like madhumakkhi ( honey bee) people crowd you like a hero. Then give some communal / controversial statement and see all media will be covering you.

If u r a trustee of a educational institute and take money and do favor to media and police and mantralaya then you rise further, you are resppected, bureacrats sanction land and licence to you to build more collges so you make more money but if you are honest and give admission only as per rules/ merits then ur own friend and relatives who wanted favours turn in to ur enemies , govt , police, officers etc keep you away, and ur institute becomes a khandahar/ ordinary place where as those who take donations and bribes their institute becomes modern, AC, luxerious well amintained institute. This is because apathy of ordinary citizens who will not support a honest worker /institute but give tons if their arms are twisted when they want admission for their wards.

Honestly reply how many honest social worker / institute u have personally supported in your life??? Where as how many times you have contributed ( as bribe or donations) when you needed their help, approached by influential rogue.

Believe me I have never ever approached anyone for any financial help or support for my activities as I will get none and will have to only be put in odd / embarrassing situation but people put their whole mite ( men and machinery) behind a corrupt neta as he will not harrass them / will help in customs when they arrive with lots of shopping, will help them when need licence/permissions/want to save their illegal structure/ will help when their wards committ some illegal acts( rash driving, drugs, fights/ etc) , and the list goes on.

Why blame politicians?? They have risen that heights because media has given them exposure and people have voted them in. Speak against people who vote on personal , communal, linguistic ground and speak against our worst judicial system who has never punished influential, biggies, VIPs, political heroes etc etc. Dawood and all other mafias r so not because they were so but because the police, media, courts found in them money making machine and backed them to the core. 60% of Mumbai is slumbai not because anything genuine but because bureacrats, police and courts ( who dish out stay /injunction on bribe) who encouraged it happen and not because of politicians. If wardofficer wanted he would not let it happen even if Gandhi nehru wanted ( top of politicians) , if police wanted they cud put them behind bars under MRTP, if courts wanted then they would have not given stays so liberally and nither wud have delayed cases for decades. So the sysytem we r having is bad society which respects criminals and bribers and we find solace in cursing politicians.

Do u find that society respects ordinary honest ??? Dont you see everyday even so called intelligensia/ successful only welocme warmly one who has money ( means to becomes monied is never cared for) ???? And u want honest politicians. We are the soil .It is we who r breeding notorious , nefarious , politicains. And then looking foe fruits when we are only letting poisonus plants to come up.

Work for improving the quality of soil( yourself) and see automatically good plants will rise. All those criticising politicians are themselves adultrators, frauds, chamchas of rich and mighty,r unetical in their proffession ( doctors, lawyers, teachers,CA.s etc etc ) they r bas contractors who do not deliver promised quality, they r selling inferior ahrdware, duplicate / cheap chinese good, putting up illegal business/ structures etc etc , and list goes on ( supposing some one approaches u that he can get u a flat in MAHADA in poor man s quota at peanut will u refuse???), develop this idea and tell me who is corrupt and this kind of society can we develop and have honets leaders???????

Lastly if by chance a very honest seffronist is contesting against your own community person who is a criminal and corrupt then whom will you vote for?? ( vice a versa I ask others too )???

Let us first be honest, deliver honestly what we committ to our customers/ clients, live simple , let us not be in a hurry to rise ( by wrong means) , pay for all services ( most take illegal connections, liceneces etc ) , help honest poor social worker and then expect honest leaders.

The only unanswerable question in the reality show Kaun Banega Crorepati is to name Mr Clean in our politics even after using all life lines.
